END USER LICENCE AGREEMENT (EULA)

This End User Licence Agreement (“Agreement”) is a legal agreement between you (“User” or “you”) and neoludic games UG (haftungsbeschränkt), a company based in Cologne, Germany (“we”, “our”, or “the Developer”), regarding your use of the software product titled Tiny Bookshop (“the Game”).
By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this Agreement. If you do not agree, do not install or use the Game.
The Developer reserves the right to change, modify, add or delete articles in this EULA at any time.
1. LICENCE GRANT
We grant you a limited, non-exclusive, non-transferable, revocable licence to download, install, and play one copy of the Game for your personal, non-commercial use.
You may not:
- Modify, reverse-engineer, decompile, or disassemble the Game.
- Use the Game for commercial purposes (e.g., in an arcade, rental, or paid streaming platform) without written permission.
- Sell, distribute, sublicense, or share the Game except through authorized platforms (e.g., Steam).
- Circumvent any technical protection measures or copy restrictions.
2. INTELLECTUAL PROPERTY
The Game and all its components — including code, graphics, music, sound effects, dialogue, and design — are protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you remain with the Developer.
You may not claim ownership of any part of the Game or use its content outside the Game without prior written permission.
3. LITERARY REFERENCES & THIRD-PARTY CONTENT
This Game may include references to books, authors, and literary works. These references are used solely for gameplay and creative engagement. All book titles, author names, and factual metadata (e.g., publication year, genre) are used in a nominative and factual manner.
Descriptions of books included in the Game are original and written by the Developer. No copyrighted text, cover art, publisher blurbs, or protected brand elements are used.
This Game is not affiliated with, endorsed by, or sponsored by any authors, publishers, or literary rights holders. All third-party trademarks and copyrights remain the property of their respective owners.
The Developer reserves the right to remove or add books to the game without prior notice to the user.

4. DISCLAIMER OF WARRANTY
The Game is provided “as is” without any warranties of any kind. We do not warrant that the Game will be free of bugs, compatible with all systems, or operate uninterrupted. You use the Game at your own risk.
5. LIMITATION OF LIABILITY
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Game — including lost profits, data loss, or hardware damage. Our total liability shall not exceed the amount you paid for the Game.
6. TERMINATION
This Agreement is effective until terminated. It will terminate automatically if you violate any of its terms. Upon termination, you must stop using the Game and delete all copies.
7. GOVERNING LAW & JURISDICTION
This Agreement shall be governed by the laws of the Federal Republic of Germany. All disputes arising from or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts located in Cologne, Germany.
8. PRIVACY AND DATA COLLECTION
This Game does not collect or transmit any personal data automatically without your consent.
However, if you choose to submit a bug report via the in-game feedback function (e.g., by pressing F2), you expressly consent to share the information you provide, which may include:
- The content you enter in the report form
- A screenshot of the game at the time of reporting
- Device information, including device model, operating system, RAM size, language settings, input device names, application version, GPU make and model, and VRAM size
- Your current save file
If you provide contact information in the report, you also consent to be contacted by the Developer regarding the report.
This data is collected solely to assist with troubleshooting and improving the Game. We handle all such information in accordance with applicable data protection laws and our Privacy Policy.
9. SAFEGUARDING CLAUSE
If any provision of this Agreement is held to be invalid or unenforceable under applicable law, such provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the provision shall be severed from this Agreement without affecting the validity or enforceability of the remaining provisions.

11. STREAMING AND CONTENT CREATION
You are hereby granted a limited, non-exclusive, worldwide licence to record, stream, broadcast, and distribute gameplay footage of the Game, including Let’s Plays and walkthroughs, for personal or commercial purposes.
This licence permits the use of in-game content solely as part of the gameplay footage and does not grant any rights to use the Game’s assets, trademarks, or content separately or out of context.
You agree not to claim ownership of the Game’s intellectual property in such content or to use it in a way that suggests endorsement by the Developer without prior written consent.
12. RESTRICTION ON USE FOR ARTIFICIAL INTELLIGENCE TRAINING
You are expressly prohibited from using the Game, its content, or any derivative works for the purpose of training, developing, or improving artificial intelligence (AI) models or machine learning systems without the Developer’s prior written consent.
This includes, but is not limited to, using the Game’s graphics, audio, text, gameplay data, or any other materials as training data, input, or reference for AI algorithms.
Any unauthorized use for AI training purposes shall constitute a material breach of this Agreement and may result in legal action.

This Agreement constitutes the entire agreement between you and the Developer regarding your use of the Game and supersedes any prior agreements or understandings, written or oral.
