While I would agree with your statement in general, Xelos is pretty much still active in CoE modding, the port for Populum was just recently published, so it shouldn't be much of a problem to reach out and ask for permission.
From what I have seen, most modders appreciate it, when others help to port their old projects, although I obviously can't speak on behalf of others.
If I change my mind I will try to contact you first :)
