I'm not sure. However, I've shanked a bartender before, and I don't think there were any consequences.

I don't think there's any penalty, but there's also no reason to do so in the first place - they don't give exp, and they don't drop gold or items.

In the Coria bar fight with the pirates, the bartender once walked over the spike trap and died. All he did was wail "why?" Didn't even drop anything.
