Death

I was attacked by a roving enemy army much stronger than me, so all my party members were killed.
Afterwards I was given the choice to Load a game, where all my characters were alive with 1 HP each. All my experience and gear seems intact. I healed them at an Inn.
Is there any penalty to having all your party die?

It depends on the defeat scenario, and there are a few in the game at the moment. In random fights, the worst case as we speak is losing all your farthings.
