I mean, I can tear one side of an Oreo off and eat only the side with more frosting, but should I? That seems like an awful waste.
Nintendo's objective is to kill the secondhand market.
They further have used multiple encryption to disable 3rd party accessories, with the threat of arbitrary permanent bricking for use of 3rd party accessories.
And because of Nintendo's EULA and ToS, you're not permitted to take any legal actions against them, outside of a laughable arbitration.

Thankfully, Brazil's government is currently serving Nintendo notice that they are violating several laws, and will be fined daily if not addressed.

Yes, they have, kid.
Sorry your precious Nintendo decided to be bigger scumbags than EA and Disney combined.
The two cases I've seen have been purely online functionality bans(which every console does). One from using a Switch flashcart(which break the ToS) and going online. The other from a username.
There hasn't been any complete bricking of systems.
Yeah, unfortunately the Nintendo fanboys are up in arms over this, and Brazil's actions.
They are violently denying the truth.
But for a company to randomly destroy a customer's $450 property is illegal, no matter how you slice it.
(Or worse, $800 in Brazil, due to regional pricing)
And yeah, countries have laws that protect consumers, and no EULA can supersede those laws.
Edit: Throw Jesters all you want, Boblin. But the fact remains that Nintendo is destroying people's property and breaking law. Deal with it.
