the last time they held elections was in 2006, plus Israel created Hamas to weaken Fatah, and also use it as an excuse to pound the Palestinians
At some point it's no longer a "War crime" when the religious fanatics are going about their civilian life knowing that Hamas is staging their operations in areas where there will be high civilian casualties if they are attacked, and supporting it because it would make Israel look bad.
In reality, it is better that some war criminals are prosecuted rather than none at all.
what would you have the civilian population of Gaza do?
Or in some cases because they're just dumb, like treating prisoners badly. All that does is encourage the enemy to die fighting no matter what.
