What’s the purpose of war crimes if…
The country that commits the crimes wins the war? You can’t enforce something if that country is wiped out.

Disclaimer: I am against war. This is just a question I randomly thought of.

I guess the purpose is to win the war?
Well could be a reason why mr Putin is so determined?
That's the whole point :kae:
When I see pictures of Ukraine and Gaza in smoking ruins I sadly realize civilization is just a thin veneer over a barbaric species.
war criminals will be safe in their own country if that country is a powerful one but there will be an ICC arrest warrant for them which will severely limit the number of countries they can travel to.
As with all things, including war crimes, nothing counts if it can't be accountable.

the country will probably be put under international sanction if they are not supported by at least one of the permanent members of the UN security council.

which is why its such a problem that no one understands how society was made or what laws are. why the fraud and corruption is such a problem

when society fails and it currently is.

rights are what you can take property is what you can defend and the cops are just another more orginized gang. and thats the problem.

Two very different civilizations there, Gaza are religious fanatics that elected Hamas, a terrorist organization known for killing civilians world-wide, and Gaza allows Hamas military to stage their military operations inside heavy civilian centers for the purpose of having those civilians act as a human-shield.

At that point is it really a war crime?
As long as you win, war crimes don't count. See: WW2

the last time they held elections was in 2006, plus Israel created Hamas to weaken Fatah, and also use it as an excuse to pound the Palestinians

Even if what you said is true, Palestine still elected Hamas, and still allows military to stage their operations inside civilian centers.

At some point it's no longer a "War crime" when the religious fanatics are going about their civilian life knowing that Hamas is staging their operations in areas where there will be high civilian casualties if they are attacked, and supporting it because it would make Israel look bad.
I think we've convinced ourselves that hypocrisy is the worst crime of all.

In reality, it is better that some war criminals are prosecuted rather than none at all.

what would you have the civilian population of Gaza do?
The real reason you don't commit war crimes is because the other country will do them back.

Or in some cases because they're just dumb, like treating prisoners badly. All that does is encourage the enemy to die fighting no matter what.
