Did u ever find out? They only seem to put their hands up 10% of the time, every other time they simply run away.

i think i figured it out. the NPC has to be alone. only the first NPC u spawn surrenders once u aim a gun at them, even if you kill every other NPC that u spawned after u spawned the first one it wont work again until you press "clear everything" and spawn another NPC. So only the first NPC u spawn after clearing everything will surrender and the second u spawn another one it will stop working until you clear everything once again.
