I meant IRL currency. Trading gifts for items is OK because they are contained within the system itself, i.e. you are not exchanging money - if they were not allowed Steam would not give people the option to trade them for other items. Also refer to the next reply for more information.

So, I've been selling games against Steam ToS all this time, even when I traded for tf2 keys/other games?

Trading is expressly permitted by the agreement:

D. Trading and Sales of Subscriptions Between Subscribers

Steam may include one or more features or sites that allow Subscribers to trade, sell or purchase certain types of Subscriptions (for example, license rights to virtual items) with, to or from other Subscribers (“Subscription Marketplaces”). An example of a Subscription Marketplace is the Steam Community Market. By using or participating in Subscription Marketplaces, you authorize Valve, on its own behalf or as an agent or licensee of any third-party creator or publisher of the applicable Subscriptions in your Account, to transfer those Subscriptions from your Account in order to give effect to any trade or sale you make.

"Does not recognize" isn't really "severe punishment".

They do punish users, we have seen it multiple times before. One of our staffers does community management for games available on Steam and she confirms Steam acts very ferociously against people who exchange gifts for IRL currency.

You are buying games when they are on sale and reselling for a higher amount to other users. The money you are getting was supposed to be paid to the developers. Example:

Game costs $10. Big sale arrives, game is sold for $2.50. Then you (and thousands more) buy dozens of copies for $2.50 and resell for $10. These $10 would have been paid to the developer if you were not present.

You also do not own the gifts/games, you own a license of them. You have no right to sell them because Steam (or the developers) did not give you this right, and they are not your property.
