We're discussing the possibility on how to incorporate it into the rate of penalty for council rather than a flat -40 for all regardless of traits. Meaning it could and SHOULD still be taken into consideration for conclave.
I'll look into this and see what I can do. No promises mind. Oh and if you have the misfortune to end up with a vassal who has a whole bevvy of negative traits, you might find him an even bigger problem than in vanilla! Hopefully, the rest of your council being less troublesome will help offset that.
I realize that that would be more work than just changing a "single digit in the code" (your words :), and you might not have time or motivation for it. Currently it feels too much like a cheat to me.

I do understand why it was implemented, to have op councils (most of the time) have penalties. It also represents how much power the medieval vassals truly had over kings. The dukes paid some of their income and provided soldiers during war, while the king defended the land using his own alongside levies of other dukes. The expecations of what leaders provided to their nobles was expected, rather than the people of a nation.
