The only reason I took it down was because I won the 2v2 tournament and decided to change and improve the design and use it for the official cape.
So in short, it's been done, fug even favorited it, it's not a problem and they don't care.
Regarding workshop copyright and DMCA, it's funny you say that as an item was affected by a DMCA takedown recently. The item was hidden as a result of the takedown request, and so the person who created it and uploaded it then deleted it.
I actually attempted to make contact with someone who supposedly knows the person making the claim, that person did not respond to my requests. I think it is a shame as the item was well made and the creator of it was not claiming any ownership of the design. I feel a solution could have been come to without the need to remove a free item, made purely for fun and not for any profit.
The workshop for Blade Symphony is a free one and no money is required in order to use an item, so in my opinion I don't believe the items should be taken down unless the person who created and uploaded the item is claiming that the design is theirs. The workshop for GMod for instance contains many more items that can be considered as having infringed copyright, more than Blade Symphony has.
There doesn't seem to be. Basically the rules are don't violoate the Steam Subscriber Agreement and as always Valve have the right to do what they like with workshop items.
It was the kitsune mask.
The original used the actual image as a texture, which is where the problem really was. If I make a similar model from scratch without using anything from him (i can easily make my own textures) he can't lay claim to it.
The style comes from a game, so if he wants to fight for the rights to the likeness/image he'll have to fight the games creators because I have just as much right to it as he does.
Not to mention he's SELLING it which is a massive NO NO, so sorry considering that author is profiting off an idea thats based off something thats not his, I don't believe he can lay claim to it.
Because as I said, he didnt create his own texture. He took the image and slapped it on the mask and used it as a texture.
Had he made his own texture that request would have held no water at all.
This is why we learn to photoshop our own textures kids, its super easy.
He used basically made a texture out of this: http://merimask.deviantart.com/art/Okami-Amaterasu-Kitsune-Mask-138289038
because he was too lazy to make his own.
Now since this person as I said is SELLING based on the likeness of something they clearly dont own they can go stick it up their ass if they want to tell me I cant use it.

On a slightly less related note:
Okami was one of the greatest games I ever played.
I look forward to seeing the mask in the workshop again.
I have/had Okaimi for Wii, only played it a little. I really should play it fully one day.
