Confederating Skaeling

I was playing as Wulfrik and chasing the Skaeling lord hoping to confederate their lands when defeated. After doing so, no confederation popup appeared.

In another (different) campaign, I saw Norsca defeating Skaeling and confederating them

Has anyone been able to confederate arteria defeating Egil Styrbjorn?
