Have you gotten the constellation class flagship tech? There are 2. The first one makes you think you can have the flagship, but its actually the 2nd tech(I think its called advanced constellation class) or some such. Once that is done, goto your starship museum, reactivate the NX class wait a month, then deactivate the NX class again and it should give you the option to then build the new flagship.

Maaatteeee that's exactly what's happened, I got the first one but it doesnt say flagship on it, so that makes perfect sense. Thank you so much. I'll smash out some research until I find it.
