I have no Senate at all when I start a new campaign.
From the tests that I did 12 seats requires that you do more to please the senate before you are granted a seat. When there are 20 seats it's possible for your family members to be given more office positions without having to do as much work for the senate in terms of missions.
In fact, it's entirely possible that you can be given an office role (usually Quaestor) before you complete any senate missions when there are 20 seats.
