From what has been stated on Play-Torchlight's Discord, it seems that no such thing is planned mostly because it's up to the Publisher to decide on that.
I can never say this enough times. Studios don't authorize plans unless they own the IP themselves.
However if we are speaking on Modders taking assets from TL3 and importing them into TL2... that is a curious question legally... very good question.
Incidentally even if the models aren't able to be imported for legal reasons, I don't think TL3's classes are quite as protected legally. Always possible to just say "so and so class mod is inspired by <insert TL3 class here>" to bypass legal issues, sorta like Synergies' Necromancer class, which is CLEARLY inspired by Diablo 2's Necromancer.
The only thing TL3 does uniquely that might be difficult to stuff into TL2 is the fort mechanic, but tbh with enough effort and scripting you could likely implement that into TL2 in some form. That being said my knowledge of modding TL2 is limited to merging or de-merging mods, so I could be wrong.

May want to check into the Torch Modders Site and ultimately their Discord where they can speak further detail about implementing these features and the limits of TL2 Modding.
